HKM Wins at Trial. HKM served as co-counsel representing defendants Delta Inn, Inc. and Hung G. Kim in a $30 million claim regarding the ownership of Delta Inn. On December 19, 2011, after a four-week bench trial in King County Superior Court, the court issued a verdict in favor of defendants.

HKM Wins Jury Verdict For Former Employee. HKM represented plaintiff Wendy Dorn in two-week jury trial regarding overtime wages. On September 15, 2011, jury returned verdict in favor of Ms. Dorn and, on November 30, 2011, the court awarded attorneys' fees.

HKM Obtains Class Certification in Overtime Claim. On September 13, 2011, the Federal District Court in Oregon certified a class of Sleep Country sales associates in an overtime claim against the company. HKM represents the Sleep Country class.

HKM Writes Employment Discrimination Section of the Washington State Practice Manual. As in previous year, HKM has written the Employment Discrimination section of the Washington State Practice Manual. The publication is expected to be published in early 2012.

HKM Prevails in Non-Compete Case. HKM represented Robert Heffner, current CEO of Falck North America, in non-compete lawsuit filed by Rural Metro Corp., after Mr. Heffner left Rural/Metro. Rural/Metro dismissed the case on November 4, 2010 after Heffner prevailed at TRO hearing.

HKM Defends Employee In Non-Compete Case. When an ex-employee of insynQ, Inc. was sued by the company for alleged violations of her non-compete agreement, she hired HKM. HKM quickly responded to the suit, immediately obtaining documents and a deposition of the company's CEO, before representing the ex-employee in a preliminary injunction hearing in Pierce County Superior Court. The decision on that hearing is expected shortly.
HKM Wards Off Vulcan Inc.'s Motion to Dismiss. HKM is representing a former employee who is suing Vulcan Inc. for discriminatory and harassing treatment, retaliation, and character defamation (among other things). The Defendants, including Paul Allen and Jodie Allen, immediately filed a Motion to Dismiss, which was initially denied by King County Superior Court, pending further briefing.
HKM Files Wage Claim Lawsuit. Representing a former employee of Moxy, Inc. HKM filed a lawsuit against the company for wages and payments owed to the employee. The lawsuit is currently pending in King County Superior Court Case (No. 12-2-08101-8).
HKM Takes Aim at Unsolicited Text Messages. Representing multiple consumers, HKM has filed class-action lawsuits against corporate entities charged with sending a barrage of unsolicited text messages (SMS). These companies include:
